Terms and Conditions
Portable Restrooms | Handwash Stations | Temporary Fence Panels | Related Equipment
These Terms and Conditions apply to the rental, delivery, setup, service, relocation, and removal of portable restrooms, handwash stations, temporary fence panels, trash cans, and related equipment provided by Today Site Services, Inc. (“TSSI”).
1. Acceptance of Terms
Customer shall be deemed to have accepted these Terms and Conditions upon the earliest of the following:
- Customer signs or electronically approves a quote, order, service agreement, or invoice
- Customer requests that TSSI proceed with delivery, setup, service, or removal
- Equipment is delivered and accepted or used by Customer
- Customer makes payment on any invoice
These Terms apply to the current order and future orders unless replaced by a later written agreement.
2. Quotes, Scheduling, and Cancellation
- Quotes are valid for 30 days unless otherwise stated
- Delivery, service, and removal dates are estimates unless confirmed
- Customer must ensure the site is ready and accessible
Additional charges may apply for:
- Relocation
- Return trips
- Wait time
- After-hours service
Cancellation Policy
- 72+ hours before: No fee
- With Cancellation Protection:
- 48–72 hours: $20
- Less than 48 hours: $40
- Without protection (less than 72 hours): 20% of rental fee
Cancellation Protection is non-refundable and order-specific.
3. Site Access and Placement
- Customer must provide safe, legal, accessible placement
- Equipment must be within 25 feet of vehicle access unless otherwise agreed
- Site must be level and suitable
Additional Terms:
- TSSI places equipment as directed if reasonable
- If no instructions are provided, placement is at TSSI’s discretion
- Relocation after delivery may incur charges
- Wait time: $100/hour billed in 15-minute increments
- Equipment must remain accessible during the rental period
4. Permits, Permissions, and Fines
Customer is responsible for:
- All permits and approvals
- Legal placement and use
Customer must reimburse TSSI for:
- Fines, penalties, towing, or citations
- A 15% administrative fee
- Legal and related costs
5. TSSI Responsibilities
- Deliver clean, serviceable equipment
- Provide routine service per agreement
- Stock standard supplies
TSSI will make reasonable efforts to meet schedules but is subject to:
- Weather
- Access
- Safety conditions
- Equipment issues
6. Customer Responsibilities
Customer agrees to:
- Use equipment properly
- Not damage, move, or misuse equipment
- Keep site clean and accessible
- Remove obstructions such as vehicles, debris, and similar obstacles
Additional Notes:
- Customer is responsible for all waste unless trash service is included
- Customer must report damage, issues, or unsafe conditions
- TSSI may require increased service, added supplies, or more units if usage exceeds the original plan
7. Sanitation Service Terms
Routine service includes:
- Pumping waste
- Restocking supplies
- Basic cleaning
Additional charges may apply for:
- Emergency or off-schedule service
- Overuse or contamination
- Inaccessible equipment
Important:
- Dry run fee: $55 if service cannot be performed
- Only standard restroom waste is permitted
8. Temporary Fence Terms
- Fence panels are freestanding 6’ x 12’ units
- No ground installation is included
Customer responsibilities include:
- Layout and placement
- Site readiness and access
- Monitoring the fence during the rental period
Additional Notes:
- Rental continues until the fence is removed
- Partial installs and removals may incur minimum charges
- Layout issues must be reported within 24 hours
Customer is responsible for:
- Damage or missing components
- Labor and repair costs
9. Prohibited Use and Contamination
The following are strictly prohibited:
- Hazardous, toxic, or flammable materials
- Construction debris, food waste, or trash in restrooms or handwash stations
Customer is responsible for:
- Cleanup, disposal, and remediation
- Equipment damage and downtime
- Government fines
TSSI may suspend or terminate service for violations.
10. Damage, Loss, Theft & Insurance
Customer is responsible for equipment from delivery to removal.
This includes:
- Theft, vandalism, and misuse
- Fire, tipping, and unauthorized relocation
- Contamination or damage
Insurance Options
- Portable Restroom Insurance: Covers accidental damage, excluding theft, misuse, and other excluded events
- Graffiti Insurance: Covers graffiti removal only
If coverage is not purchased, Customer is responsible for full repair or replacement costs.
11. Service Suspension or Termination
TSSI may suspend or terminate service if:
- Payment is overdue
- These Terms are violated
- Equipment is misused or unsafe
- Site is inaccessible or hazardous
Customer remains responsible for all charges due.
12. Billing and Late Fees
- Rentals are billed in advance
- Recurring rentals are billed every 28 days unless otherwise stated
Additional charges may include delivery, relocation, extra service, damage, and related costs.
Late Payment Terms
- Equipment may be removed after 14 days overdue
- A 10% late fee may apply every 7 days
- Customer is responsible for collection costs
13. Taxes
Customer is responsible for all applicable taxes and government charges.
14. Additional Charges
Charges may apply for:
- Blocked access
- Missing instructions
- Relocation requests
- Contamination or misuse
- Site delays
15. Limitation of Liability
TSSI is not liable for indirect or consequential damages, including lost profits or delays. Total liability is limited to the amount paid for the service at issue.
16. Indemnity
Customer agrees to indemnify TSSI against claims arising from:
- Equipment use or misuse
- Unsafe site conditions
- Failure to obtain permits
- Damage, theft, or contamination
- Actions of Customer or third parties
17. No Purchase Order Terms Control
Customer documents do not override these Terms unless agreed to in writing by TSSI.
18. Corrections
TSSI may correct clerical or administrative errors in quotes, invoices, or service documents.
19. Governing Law
These Terms are governed by California law, and disputes must be brought in California courts unless TSSI agrees otherwise in writing.
20. Entire Agreement
These Terms, together with the applicable quote, invoice, service order, or written agreement, constitute the full agreement between the parties.
